# Terms of Service

## 1. Acceptance of Terms

By accessing or using LiquidLottery ("the Protocol", "the Service", "the dApp") at **liquidlottery.app** you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. **If you do not agree, you must not use the Service.** Accessing the Service constitutes your unconditional acceptance of these Terms.

## 2. Description of the Protocol

LiquidLottery is a set of **autonomous, open-source smart contracts** deployed on Hyperliquid L1 (HyperEVM, Chain ID 999). It is not a gambling operator, lottery service provider, or any other type of regulated entity. Randomness is sourced on Base via Chainlink VRF v2.5 and relayed cross-chain through Chainlink CCIP. The Protocol operates exclusively through immutable smart contracts; no centralised server stores your funds, controls the outcome of any draw, or acts as a custodian of any kind.

The website at **liquidlottery.app** is an **optional interface** that allows users to interact with the Protocol's publicly deployed smart contracts. Anyone may interact with the Protocol directly via the blockchain — without using this website or any other frontend — by calling the smart contract functions directly. The existence of this frontend does not create any service relationship, custodial relationship, or legal obligation on the part of the developers or contributors.

## 3. Eligibility

You must meet **all** of the following conditions to use the Protocol:

- You are at least **18 years old** (or the age of legal majority in your jurisdiction, whichever is higher).
- Your use of the Protocol does not violate any applicable law, regulation, or court order in your jurisdiction.
- You are not located in, resident of, or a national of any **Restricted Jurisdiction** as defined below.
- You are not listed on any governmental or intergovernmental sanctions list (including OFAC SDN, EU Consolidated List, or equivalent).

### Restricted Jurisdictions

Access to and use of the Protocol is **not permitted** from the following jurisdictions:

**Jurisdictions requiring a local gambling licence (which the Protocol does not hold):**
Italy, France, Spain, Germany, United Kingdom, Netherlands, Sweden, Denmark, Belgium, Austria, Portugal, Greece, Romania, Hungary, Czech Republic, Australia.

**Jurisdictions where online gambling is prohibited or heavily restricted:**
United States, Turkey, United Arab Emirates, Qatar, Saudi Arabia, Iran, China, North Korea, India (states where online gambling is prohibited), Russia, Brunei.

**Sanctioned jurisdictions (OFAC / EU sanctions):**
North Korea, Iran, Syria, Cuba, Russia, Belarus, Myanmar, and the Crimea, Donetsk, and Luhansk regions.

The above list is provided for guidance and is not exhaustive. Other jurisdictions may have restrictions on blockchain-based applications, decentralised finance, or games of chance that apply to you.

**By accessing or using the Protocol, you represent and warrant that:**
1. You have independently verified the legality of your participation under all applicable laws, regulations, and rules in your jurisdiction.
2. You are not located in, a resident of, or a national of any Restricted Jurisdiction listed above.
3. **You bear sole and exclusive responsibility for ensuring your use of the Protocol complies with all applicable laws in your jurisdiction.** The developers and contributors of LiquidLottery do not provide legal advice and accept no liability for any user's non-compliance with local laws.

We reserve the right to update the list of Restricted Jurisdictions at any time without notice.

## 4. No Custodial Relationship

The Protocol is strictly non-custodial. **No entity — no company, corporation, individual, developer, or contributor — custodies, controls, or has access to user funds at any time.** All funds deposited into or held by the Protocol are managed exclusively by immutable smart contract code deployed on a public blockchain. You retain full control of your wallet and private keys at all times. The developers of LiquidLottery have no ability to pause withdrawals, freeze funds, redirect prizes, or perform any custodial action.

Losing access to your wallet is irreversible; no party can recover funds on your behalf under any circumstances.

## 5. Risk Acknowledgement

You expressly acknowledge and accept the following risks:

- Smart contracts may contain undiscovered bugs or vulnerabilities despite automated testing and peer review.
- Ticket purchases are **final and non-refundable** except in the case of an emergency cancel triggered autonomously by the Protocol's smart contract.
- Cryptocurrency (HYPE) values are highly volatile. The value of any winnings may change significantly between the draw and the time you claim your prize.
- Blockchain transactions are irreversible. Sending funds to the wrong address results in permanent loss.
- Network congestion, outages, or forks may temporarily or permanently prevent you from interacting with the Protocol.
- Chainlink VRF and CCIP are operated by third parties; any failure of these services may affect the Protocol.

## 6. Protocol Fees

A protocol fee is deducted from each ticket purchase as specified in the smart contract. The fee allocation (jackpot pool, super pool, and owner fee) is enforced on-chain and cannot be altered without a publicly announced 72-hour upgrade timelock. The current fee structure is visible at any time by inspecting the on-chain contract state.

## 7. Prohibited Use

By using the Service, you agree that you will **not**:

- Use the Service from any jurisdiction where such activity is prohibited.
- Attempt to reverse-engineer, exploit, manipulate, or disrupt the smart contracts or the web interface.
- Use the Service for money laundering, terrorist financing, or any other illegal activity.
- Use automated bots, scrapers, or scripts to interact with the web interface in a manner that degrades service for other users.
- Impersonate the LiquidLottery team or create confusion about the official Service.

## 8. Intellectual Property

The LiquidLottery smart contract source code is open-source and subject to its applicable licence. The website design, branding, and non-contract software are the property of their respective authors. Nothing in these Terms grants you any licence to use the LiquidLottery name, logo, or branding.

## 9. Disclaimer of Warranties

**THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK.**

## 10. Limitation of Liability

**TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPERS, CONTRIBUTORS, AND OPERATORS OF LIQUIDLOTTERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF FUNDS, LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT OF PROTOCOL FEES YOU PAID IN THE THREE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR €100, WHICHEVER IS LESS.**

## 11. Indemnification

You agree to defend, indemnify, and hold harmless the developers, contributors, and operators of LiquidLottery from and against any claims, liabilities, damages, judgements, awards, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Service.

## 12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable international law. Any dispute arising out of or in connection with these Terms shall first be submitted to good-faith mediation. If mediation fails, disputes shall be resolved through binding arbitration, and the parties waive any right to a jury trial or class-action proceeding to the fullest extent permitted by law.

## 13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

## 14. Entire Agreement

These Terms, together with the Privacy Policy and Risk Disclaimer, constitute the entire agreement between you and LiquidLottery with respect to the subject matter herein and supersede all prior agreements.

## 15. Changes

We reserve the right to modify these Terms at any time. The "Last updated" date at the top of this document will be revised accordingly. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
